Agreement between User and Tafawaq
Welcome to Tafawaq. This website is comprised of various web pages operated by Tafawaq. The Tafawaq platform is offered to you conditioned on your acceptance, without modification, of the terms, conditions, and notices contained herein (the "Terms"). Your use of Tafawaq constitutes your agreement to all such Terms. Please read these Terms carefully and keep a copy of them for your reference.
Tafawaq is an online learning platform that connects students with teachers for live online lessons and provides access to recorded lessons, courses, and other educational digital content.
1. General Terms
1.1 Our platform connects students with teachers for one-to-one or group online lessons and provides access to recorded lessons and courses.
1.2 All users (students and teachers) must register with accurate, complete, and truthful information and keep their account details up to date.
1.3 We reserve the right to modify or update these Terms and Conditions at any time. Updates will take effect as soon as they are posted on this page. Your continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
1.4 Unauthorized use of the website, including attempts to hack, misuse, probe security vulnerabilities, or distribute harmful content (such as viruses or malware), is strictly prohibited.
1.5 Live lessons are delivered online using our platform or integrated tools. Students are responsible for ensuring they have a stable internet connection, a suitable device, and the required software or browser capabilities. For recorded lessons and courses, students are responsible for having a compatible device, sufficient storage (if downloads are explicitly enabled), and a stable internet connection for streaming.
Electronic Communications
Visiting Tafawaq or sending emails or messages to us constitutes electronic communications. You consent to receive electronic communications from Tafawaq, and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email, within your account, or on the site, satisfy any legal requirement that such communications be in writing.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device or account. You agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Tafawaq is not responsible for third-party access to your account that results from theft or misappropriation of your account credentials. Tafawaq reserves the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion.
Children and Age Restrictions
Tafawaq does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use Tafawaq only with the permission and supervision of a parent or guardian.
2. Payments and Wallet
2.1 Payments can be made by credit card, PayPal, or through the wallet feature (where available).
2.2 The wallet can be charged using credit card, PayPal, or other supported payment methods. Wallet balances are generally non-refundable but may be used for future bookings and purchases in accordance with these Terms and any additional wallet rules shown on the site.
2.3 All fees must be paid in full and successfully processed before a booking is confirmed or before access to paid recorded content is granted.
2.4 Group lesson tickets, bundles, and recorded courses are subject to availability and any specific terms displayed at the time of purchase (including access period and expiration, if any).
3. Cancellation and Refund Policy
3.1 Students may cancel a booked live lesson up to 24 hours before the scheduled start time to receive a full refund or credit to their wallet, according to the options shown on the site.
3.2 Cancellations of live lessons made less than 24 hours before the lesson start time are non-refundable and the lesson will be considered as used.
3.3 If a teacher cancels a live lesson, students will be offered a full refund or the option to reschedule at no additional cost.
3.4 No-shows (students or teachers who do not attend a scheduled live lesson without prior notice) will be treated as completed lessons and will not be refunded.
3.5 Purchases of recorded lessons, recorded courses, and other digital content may be non-refundable once access has been granted or content has been viewed or downloaded, except where required by applicable law or clearly stated otherwise at the time of purchase.
3.6 Specific courses, programs, bundles, or promotions may have additional or different cancellation and refund rules, as displayed at the time of purchase.
4. Terms for Students
4.1 Students must create an account and provide accurate personal and contact details when booking lessons or purchasing tickets and courses.
4.2 Students must ensure that payment is successfully completed before lesson confirmation or before accessing paid recorded content. If payment fails, the booking or access may be automatically cancelled.
4.3 Sharing access links, login details, or any paid access (including live lesson links, recorded lessons, recorded courses, or tickets) with non-paying users is strictly prohibited.
4.4 Students are responsible for attending live lessons on time. Late arrivals may result in a shorter lesson, and the teacher is not obligated to extend the session beyond the original scheduled time.
4.5 Misuse of the platform, abusive behavior towards teachers or other users, or violation of these Terms may result in suspension or termination of the student's account without refund.
4.6 Students are not allowed to record, copy, download (where not explicitly enabled), screen-capture, rebroadcast, or redistribute any live or recorded lessons, courses, or materials without prior written permission from Tafawaq and the content owner.
5. Terms for Teachers
5.1 Teachers must provide accurate and truthful information about their qualifications, experience, and identity when registering.
5.2 Teachers are responsible for attending live lessons on time and providing high-quality teaching services as described in their profiles and course descriptions.
5.3 Teachers must not share student personal information with third parties and must respect student privacy at all times.
5.4 Payments for lessons and recorded content will be processed through the platform in accordance with the payout schedules and commission structure displayed to teachers (for example, platform fees or commissions).
5.5 Repeated cancellations, no-shows, or failure to deliver lessons or recorded content with reasonable quality may result in suspension or termination of the teacher’s account.
6. Recorded Lessons, Courses and Digital Content
6.1 When you purchase or access recorded lessons, recorded courses, or other digital content on Tafawaq, you are granted a personal, limited, non-exclusive, non-transferable license to view and use that content solely for your own private, non-commercial learning purposes.
6.2 You may not share, resell, rent, sublicense, publish, upload, post, transmit, or otherwise distribute any recorded lessons or digital content to any third party, whether for free or for payment, without prior written permission from Tafawaq and the rights holder.
6.3 Unless the platform clearly provides a download option, all recorded content is offered on a streaming-only basis. You may not use any tools, software, or technical methods to download or permanently copy content that is intended only for streaming.
6.4 Recording, screen capturing, or otherwise reproducing any part of live or recorded lessons (including video, audio, slides, chat messages, or shared materials) is strictly prohibited, unless you have obtained prior written permission from Tafawaq and the content owner.
6.5 All recorded content remains the intellectual property of Tafawaq or the respective teacher/content creator. Any violation of these rules regarding recorded content may result in immediate suspension or termination of your account, without refund, and may expose you to legal liability.
Links to Third-Party Sites / Third-Party Services
The Tafawaq website may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Tafawaq, and Tafawaq is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Tafawaq provides these links only as a convenience, and the inclusion of any link does not imply endorsement by Tafawaq of the site or any association with its operators.
Certain services made available via the platform may be delivered by third-party sites and organizations (such as payment processors, communication tools, or hosting providers). By using any product, service, or functionality originating from a third-party, you acknowledge and consent that Tafawaq may share data with such third parties as necessary for them to provide the requested product, service, or functionality to you.
No Unlawful or Prohibited Use / Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use Tafawaq strictly in accordance with these Terms of Use. As a condition of your use of the site, you warrant to Tafawaq that you will not use the site for any purpose that is unlawful or prohibited by these Terms. You may not use the site in any manner which could damage, disable, overburden, or impair the site or interfere with any other party's use and enjoyment of the site.
All content included as part of the service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the site, is the property of Tafawaq or its suppliers and protected by copyright and other laws. You agree not to modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content found on the site, except as expressly permitted. Your use of the site does not entitle you to any ownership rights in any protected content.
Use of Communication Services
The site may contain bulletin boards, chat areas, forums, communities, message systems, or other communication tools designed to enable you to communicate with others ("Communication Services"). You agree to use the Communication Services only to post, send, and receive messages and material that are proper and related to the particular Communication Service.
For example, and not as a limitation, you agree that you will not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others; publish or distribute any inappropriate, obscene, or unlawful material; upload files that contain malware; or violate any applicable laws or regulations.
Tafawaq has no obligation to monitor the Communication Services but reserves the right to review materials posted and to remove any materials in its sole discretion, and to terminate your access to the Communication Services at any time without notice.
User Content and Submissions
Tafawaq does not claim ownership of the materials you provide or upload to the platform ("Submissions"). However, by posting, uploading, inputting, providing, or submitting your Submission, you grant Tafawaq a non-exclusive license to use your Submission in connection with the operation and promotion of the platform, including the rights to copy, distribute, transmit, publicly display, and reformat your Submission, subject to our Privacy Policy and applicable law.
Teachers who upload recorded lessons or courses grant Tafawaq the necessary rights to host, stream, and provide access to that content to students in accordance with these Terms.
You warrant that you own or otherwise control all of the rights to your Submissions and that your Submissions do not infringe the rights of any third party.
Third-Party Accounts
You may be able to connect your Tafawaq account to third-party accounts (such as social login providers or communication tools). By connecting these accounts, you acknowledge and agree that you are consenting to the sharing of certain information in accordance with your settings on those third-party services. If you do not want information about you to be shared in this manner, do not use this feature.
Indemnification
You agree to indemnify, defend, and hold harmless Tafawaq, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the site or services, your user content, your violation of any of these Terms, or your violation of any rights of a third party or applicable law.
Liability Disclaimer
While we aim to provide a reliable and high-quality service, Tafawaq is not responsible for:
- Technical issues beyond our control (such as internet outages, device failures, or downtime of third-party tools or services).
- The quality, style, or outcome of individual lessons delivered by teachers.
- Any indirect, incidental, special, or consequential damages arising from the use of the platform, to the maximum extent permitted by law.
To the maximum extent permitted by applicable law, all services and content are provided "as is" without warranties of any kind, whether express or implied.
Tafawaq reserves the right, in its sole discretion, to terminate or suspend your access to the site and related services, or any portion thereof, at any time, without notice, if we believe you have violated these Terms, misused the platform, or engaged in fraudulent or harmful activity.
Changes to Terms
Tafawaq reserves the right, in its sole discretion, to change the Terms under which the platform is offered. The most current version of the Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of any updates.
